""The Judicial Commission of Inquiry set up to probe the killing of security forces in Alakyo Village in Nasarawa State has been told that it lacked the legal powers to carry out some of its assigned duties. It may be recalled that security operatives were ambushed and massacred by suspected members of the Ombatse Militia Group in Alakyo village, on May 7. However, Counsel to the group, Mr Zakaria Alumaga challenged the powers of the commission to probe the killings which was set up by the Nasarawa State government to investigate the killing of several security operatives and was inaugurated sometime in May. Mr Alumaga faulted the headship of the commission based on by the penal code, which was used to outlaw the group. The legal team of the Ombatse Militia, the group suspected to have masterminded the massacre, raised a preliminary objection to enable the commission decide whether it was competent to adjudicate on some of the provisions contained in its terms of reference as regards the alleged proscription of group by the Nasarawa State Government in 2012. However, the state government dismissed the objection. The State Attorney General and commissioner of Justice Nasarawa state, Mr Innocent Lagi observed that the commission is all about fact finding and not a commission for legal interpretations. The commission is however progressing with its mandate. The Nigerian Police is expected to make its presentation on August 6th; the State Security Service will make its presentation on August 14th while the Nasarawa state government will be heard on August 15th.
